A COUNTY motorist has been jailed and had his car confiscated after he was caught driving the vehicle while disqualified.
Richard Kelly was spotted behind the wheel of his white BMW as he drove along an unclassified road close to Smeaton Farm, near Whitecraig.
Kelly, 36, was stopped by police officers between the A6094 and B6414 roads and it was discovered that he was serving a road ban imposed by a court for a previous offence.
During the incident on October 9, Kelly was taken to the Royal Infirmary of Edinburgh, where he refused to give police officers a blood specimen to ascertain the level of alcohol in his blood.
Kelly, of Muirpark Place, Tranent, pleaded guilty to two offences when he appeared at Edinburgh Sheriff Court last month and he was remanded in custody ahead of sentencing.
He was back in court last Tuesday, where Sheriff Peter McCormack sentenced him to a 48-day custodial sentence.
The sheriff also banned Kelly from driving for two years and granted the Crown’s motion for forfeiture of the vehicle.
The Crown previously accepted not guilty pleas to four other charges including driving with no insurance, failing to give police details, refusing a roadside breath test and refusing a roadside drug test on the same date.
