A Musselburgh man shouted and swore at his former partner after spotting her in a car with another man.

James Givan also became involved in a physical struggle with his ex during the incident outside the Asda supermarket in Tranent.

Givan pleaded guilty to an amended charge of behaving in a threatening or abusive manner when he appeared at Edinburgh Sheriff Court last Thursday.

Fiscal depute Drew Long told the court that Givan turned up at the supermarket car park in May last year and, after seeing the woman with another man, he “lost his temper”.

Mr Long said: “Mr Givan ran towards [his former partner] as she got out of the car.

“He pushed her and there was a struggle and Mr Givan shouted at her and the man in the car.

“He shouted and swore at both of them about how they were spending time together.”

The court heard that the police were called to deal with Givan, of Pinkiehill Crescent, and he was arrested and charged.

Mr Long said that 30-year-old Givan had abided by his bail conditions not to contact his ex-partner and that she did not want a non-harassment order to be imposed.

Lawyer Angela Craig said her client had “unhappy experiences with relationships in the past” and he had “begun to have suspicions about [his former partner] seeing another man”.

Ms Craig added that the woman had denied starting a new relationship and Givan had “lost his temper after seeing her in the car with another man”.

The solicitor said that since the incident there had been “no repetition, no issues and he has no [criminal] record”.

Sheriff Roderick Flinn said that Givan had committed “a minor offence” and deferred sentence for him to be of good behaviour to June this year.

The sheriff said that if Givan stayed out of trouble until then, he would receive an admonition but, if not, he would most likely be ordered to pay a fine.

Givan pleaded guilty to behaving in a threatening or abusive manner by acting in an aggressive manner, shouting, swearing and struggling with his former partner at Asda, High Street, Tranent, on May 20 last year.
