Banned from playing loud music

A TRANENT man whose playing of loud music upset his neighbours has been hit with a full anti-social behaviour order (ASBO).

East Lothian Council was granted a full ASBO against Mark Stevenson, of John Crescent, at Haddington Sheriff Court on May 5. It was served on 41-year-old Mr Stevenson last Monday.

The court heard of complaints about excessively loud music being played from Mr Stevenson"s home, and that he had been shouting and swearing at neighbours.

The terms of the ASBO will prevent him from playing loud music or allowing loud music to emit from his home, or behaving in a way that causes, or is likely to cause alarm or distress to others.

Lasting for a period of 12 months, the full ASBO replaces the terms of an interim ASBO granted against Stevenson in May 2008. Interim ASBOs are used to protect others from an individual"s behaviour while the legal process is ongoing.

Breaching the terms of an ASBO (either full or interim) constitutes a criminal offence. Depending on the severity of the breach, the case may be dealt with by the sheriff court, which can impose up to six months imprisonment or a fine of up to £10,000 (or both); or by the high court, which can impose a term of imprisonment of up to five years, an unlimited fine or both.

Councillor Stuart Currie, cabinet member for housing and community services, said: 'Our anti-social behaviour team worked closely with Lothian and Borders Police to compile a dossier of evidence that we could use in court.

'I"m pleased that the full ASBO was granted, and hope it will bring peace for Mr Stevenson"s neighbours and act as a warning to others.'
